1. Acceptance of Terms
By accessing meadowcreekhypnotherapy.com (the “Site”), booking a session, downloading digital content, or otherwise engaging with Meadow Creek Hypnotherapy (“MCH,” “we,” “us,” “our”), you (“you,” “User,” or “Client”) agree to be bound by these Terms of Use & Terms and Conditions (“Terms”). If you do not agree, please do not use our Site or services.
2. Services
MCH provides:
- Private and group hypnotherapy sessions (in-person or virtual)
- Self-hypnosis recordings and digital programs
- Coaching, workshops, and educational materials
These offerings are complementary wellness services, not a substitute for licensed medical, psychological, or psychiatric care. Always consult a qualified health-care professional regarding any condition.
3. Eligibility
To book or purchase from MCH you must:
- Be 18 years or older (or provide written parental/guardian consent).
- Be mentally capable of giving informed consent and making decisions about your well-being.
- Understand hypnotherapy’s complementary nature and accept sole responsibility for your physical, mental, and emotional health.
4. Confidentiality & Privacy
All sessions, forms, and communications are confidential and safeguarded in line with our Privacy Policy & HIPAA Notice of Privacy Practices. We will only disclose information with your written authorization or when legally required (e.g., danger to self/others, court order).
5. Booking, Payment, Cancellation & Refunds
- Payment is due at booking via our secure payment processor; we never store card details.
- Cancellation, rescheduling, and refund rules are detailed in our Cancellation, Refund & Rescheduling Policy. Late cancellations (< 24 hours) and no-shows incur a 50 % fee; completed sessions and digital products are non-refundable.
- Package sessions must be used within the timeframe stated at purchase; unused sessions expire.
6. Health & Results Disclaimer
Hypnotherapy outcomes vary; no specific result is promised or guaranteed. You participate voluntarily and release MCH from liability for decisions you make based on sessions, recordings, or coaching.
7. Limitation of Liability
To the maximum extent permitted by law, MCH, its owners, contractors, and affiliates will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or services. Aggregate liability will not exceed the amount you paid to MCH in the preceding 12 months.
8. Indemnification
You agree to indemnify and hold harmless MCH and its practitioners from any claims, losses, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or misuse of the Site or services.
9. Intellectual Property
All content on the Site—including audio recordings, videos, text, graphics, and logos—is owned by or licensed to MCH and protected by U.S. and international intellectual-property laws. You may not reproduce, distribute, or modify any content without our prior written consent.
10. Permitted Website Use
You agree not to:
- Violate any applicable laws or regulations;
- Attempt to gain unauthorized access to our systems;
- Upload malicious code or engage in data scraping;
- Use the Site to harass, defame, or harm others.
11. Telehealth & Technology
Virtual sessions are delivered via HIPAA-enabled platforms. You are responsible for a stable internet connection, a private environment, and any device security (e.g., antivirus).
12. Third-Party Links & Tools
The Site may contain links to third-party websites or tools. MCH does not control and is not responsible for third-party content, privacy practices, or services. Use them at your own risk.
13. Changes to Terms
We may update these Terms at any time. Continued use of the Site or services after a revision becomes effective constitutes acceptance of the new Terms. The “Last Updated” date reflects the latest changes.
14. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-law principles.
- Informal resolution first: Please contact us to resolve any dispute.
- Arbitration: If we cannot resolve a dispute informally, both parties agree to binding arbitration in Utah County, Utah, under the rules of the American Arbitration Association.
- Exception: Either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual-property or confidentiality rights.
15. Severability & Waiver
If any provision of these Terms is deemed unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of future enforcement.
16. Entire Agreement
These Terms, together with our Privacy Policy, HIPAA Notice, and Cancellation/Refund Policy, constitute the entire agreement between you and MCH regarding the Site and services, superseding all prior agreements or understandings.
